Liability Definitions
Personal and Advertising Injury Liability
This coverage is used to insure against claims of libel, slander, product disparagement, piracy, infringement of copyrights, etc. that arise out of the advertising of your goods, products, or services.
Medical Payment
This coverage reimburse, without regard to your liability, all reasonable medical expenses incurred by persons as a result of bodily injury sustained by accident as defined in your policy.
Premises/Operations
This coverage is used to insure against claims arising out of your ownership, maintenance or use of premises including any operations that are in progress.
Products/Completed Operations
This coverage is used to insure against claims arising out of bodily injury and property damage that result from products you have sold, manufactured, handled, distributed or disposed of; or for work you have performed, provided the accident occurs away from premises you own or rent.
Audit Premium
The proposed premium is based on the following estimates of annual exposures. They are subject to audit after expiration of the policy.
Contractual Liability
This coverage is used to insure against bodily injury and property damage claims arising out of the liability of others that you assume in an "insured contract" as defined in the policy.
Employee Benefits Liability
This coverage is used to insure against negligent acts, errors or omissions, committed by you or any person whose acts you are legally responsible for while engaging in the administration of your company's employee benefit plans.
Legal Liability
This coverage is used to protect you against legal liability that results from damage to specified property of others from a covered cause of loss while in your care, custody or control.
Mechanical Breakdown Coverage
This insurance is used to cover the costs to repair or replace listed parts, for a stated period of time, due to mechanical breakdown or failure. It is written as excess coverage over the manufacturer's new product warranty.
World Wide Coverage
This endorsement is used to extend your CGL policy to include coverage for lawsuits brought against you in those additional parts of the world as outlined in the endorsement. This is needed since without this extension lawsuits (excluding those arising from internet activities) are only covered if they are brought against you within the territories of the United States, Puerto Rico, or Canada.
Additional Insured's
This endorsement is used to extend your Liability policy to include protection for those additional insured's listed on the form. This is needed because your policy does not provide automatic coverage for these individuals/entities.
Fellow Employee Coverage
This endorsement is used to extend your Liability protection to insure against claims filed by one employee against another for alleged negligent acts. This exposure is excluded in your standard policy since it is intended for this type of claim to be insured under your Workers' Compensation coverage Workers Comp Form. Generally, states allow employees the right to not only claim compensation, but also maintain their right to sue third parties for damage. Unfortunately, in many states there is no clear definition of what is a third party. Therefore, a suit could potentially be brought against an employee as a third party.
Molestation or Abuse Coverage
This endorsement extends your General Liability policy to include coverage for claims alleging actual or threatened abuse or molestation of any person while in the care, custody, or control of you or your employees.
Punitive Damages Coverage
Liability coverage can be written to include protection for claims arising out of punitive damage awards. This is important since many state statutes today make punitive damage a very real hazard.
Watercraft Liability Coverage
This endorsement is used to extend your CGL policy to insure against claims resulting from the use of watercraft as specified in the form. It is necessary because standard liability forms provide very little coverage for claims that arise out of the ownership, maintenance, use, or entrustment of watercraft owned, operated, rented, or loaned to you.
